Provide withdrawal information for your offers
Withdrawal information explains whether and how consumers can withdraw from their contract. You provide one document for your business, clearly assigning different rules to the relevant courses, cards or subscriptions.
Development preview: locally prepared help article, not yet released. General guidance for Germany, not individual legal advice.
You manage your provider and know your business’s legal identity and the offers you sell.
What is required?
The information depends on the offer. Where a statutory withdrawal right exists, customers need appropriate instructions and the model withdrawal form. Where a statutory exception applies, such as for certain scheduled leisure services, customers must instead be informed that the right does not exist.
Provide this information for consumer offers in courseplanner even if you do not use your own course terms. There is no discretionary switch to exclude statutory rights. This guide provides general orientation for Germany, not an assessment of your individual case.
Assess the actual contracts
Consumer distance contracts generally carry a right of withdrawal. Section 312g(2)(9) BGB provides an exception for certain leisure services where the contract specifies a date or period. A fixed date alone is insufficient; the type of service must also fall within the exception.
Assess cards and subscriptions by the contract made at purchase. Later booking of individual dates does not automatically exclude the withdrawal right for the card or subscription contract. Obtain qualified advice on unclear or mixed offer models.
- Identify the contracts customers actually conclude: individual courses, cards and subscriptions.
- For each offer type, establish whether a withdrawal right exists or which specific statutory exception applies.
- Use clear offer descriptions so customers can identify their contract in the document.
One document with clearly scoped sections
courseplanner uses one shared withdrawal information document per provider. Separate files are not assigned to individual booking options. If different rules apply, organize the document by clearly named offer types.
State which contracts each section covers. If some offers carry a withdrawal right and others fall within a statutory exception, do not apply the exception notice to all offers. Adding an offer type may require revising the shared document.
Instructions, model form or exception notice
For contracts carrying a withdrawal right, explain in particular the period and when it begins, the procedure, recipient and consequences. Include the statutory model withdrawal form in the same document. A correctly adapted statutory model instruction can provide a starting point; its drafting notes must match your contract.
For an applicable statutory exception, identify the affected offers and clearly state that there is no statutory withdrawal right. Do not use a blanket waiver or invent an exception.
If services are to start before the withdrawal period ends, additional information and express statements may be required. A sentence in an uploaded document or general acceptance of terms does not replace those statements.
Add text or a PDF
Open “Contract and privacy” during setup or in provider settings and find “Withdrawal information”. Choose complete text with 100–60,000 characters or a static, unencrypted PDF up to 512 KiB without active content or embedded attachments. One file containing instructions and the model form is enough; this field is not a form for customers to submit a withdrawal.
You can use headings, bold, italics, underlining, bullet points, numbered lists and links. The character limit applies to visible text. Check formatting in “Preview text”; after saving, it is retained in the published text view.
Review every section, confirm publication and choose the shared “Save” button. Unchanged content keeps its existing version. You can retain an existing PDF unless you want to replace it.
The published version is available in the Legal documents area on your provider’s Legal page. Text is displayed directly and PDFs are offered for download. Your content is not automatically translated and may be publicly readable after publication before your provider profile goes live.
Match the document to the actual process
Customers must have clear access to withdrawal information before submitting their binding contract declaration. Required contract information must generally also be supplied on a durable medium unless already supplied that way beforehand. A webpage that can later change does not by itself replace this delivery.
An electronic withdrawal function required under section 356a BGB has its own process, including confirmation and an acknowledgment of receipt. Adding this document alone does not set up that process. Before starting sales, also check the associated information, delivery and functional duties.
Canceling an individual booking, statutory withdrawal and terminating an ongoing subscription are different actions. Your withdrawal information does not change cancellation percentages, refund logic or subscription termination settings.
Changes, errors and help
Review the information when offer types, contact channels or relevant rules change. First check which existing contracts are affected; replacing the public version does not retroactively change existing rights.
When a version conflict occurs, compare the current version with your draft and confirm again. If only some steps save, follow the successful-step feedback and retry the outstanding steps. After a successful save, check the public text or download.
